About the use of this website
and our communicationThis User Agreement applies to web sites and interactive services owned
or operated by 4netPlayers.com. Hereinafter, 4netplayers.com may be referred to as “we,” or
“us”.
These Terms and Conditions apply to visitors and registered members of the 4players
website. By accessing, using, viewing, reading, printing, installing, or downloading any material from us, or becoming a
member of 4players, you agree to be bound by these Terms and Conditions.
Please read these Terms and
Conditions carefully before using and/or purchasing goods from us. If you have any questions or feel unsure about
any of the content set out in these terms, please contact our Customer Service for further advice.
4netPlayers may change these Terms & Conditions at any time. You are responsible for checking periodically for
changes and your continued use of the Services after the Effective Date indicates your acceptance of the new Term &
Conditions.
Our Service4Players provides services (free and paid), offers, content and products on the basis of these General Terms and
Conditions. These can be supplemented in some cases by product-specific service descriptions of 4Players.
In
some cases4Players offers links to third-party companies through our website such as the TeamSpeak voice over
service.
1.Registering with us
1.1 By registering with us you have access to our services such as forums, chat, My4Players system and game
server hosting service. You can actively participate in the discussion forums, chat rooms and comments pages on our
website.
1.2 A contract is only concluded once we have accepted your registration request. This Agreement is
concluded for an indefinite period and may be terminated by you (the user) at any time without notice.
1.3 If
you would like to create an account with us, please provide a username and password. Once registered, you will be given
a unique personal log-in name and password by email.
1.4 Your personal details will be stored behind your
log-in name and password and can only be accessed and changed by you. Please note your membership and password details
may not be assigned, transferred, or sold to a third party. If a user fraudulently obtains access, we have the right to
terminate membership immediately.
1.5 By registering with us you confirm that you are at least 18 years of
age and that you have the legal capacity to enter into this Agreement.
1.6 4players reserves the right to
reject a registration request without giving reasons

2. Services and contents of 4Players2.1 4Players
is a games portal providing games from all areas for download.
2.2 We hold regular competitions on our site
in which all registered users can participate. This excludes all 4players employees and their dependents. Every person
entering into our competitions have an equal chance of winning. In no way are your chances affected by the
regularity in which you use our games.
3. User
Obligations
3.1 The user agress to the lawful use of the services of
4Players.
3.2 The User agrees to pay the agreed fee . Failure to maintain payment of
the fee will result in the users account being disabled. The user account will remain disabled until payment has been
received. This lock does not release the user from the obligations to pay.
3.3 The user
agrees that all information provided in the registration process is correct. Should any of the details provided
change, the user must inform 4players of this. Failure to do so could result in the user account being disabled. We
reseve the right to claim for any damages in relation to the violation of this agreement.
3.4 The User agrees to carefully store the user name and password to protect against unauthorised access by
third parties. Failure to fulfill this obligation will render the owner responsible for any consequences arising
from improper use of the account.
3.5 The user will refrain from distributing content which
infringes on third party rights. Any inappropriate content posted on the site such as through discussion forums, chat or
comment features will be removed and the users account may be disabled.
4. Terms for 4Players game server hosting service4.1
4Players offers game server hosting services over the internet. In order to use our services you are required to pay a
fee. The fee is dependent on the requested service. The fee paid will be based on the prices shown at the time of
ordering.
4.2 We reserve the right to extend the services provided and to alter or make improvements. In
particular we are entitled (at any time) to improve the selection of the games, modification options, additional tools
(Admin Tools) and/or the operating system.
4.3 The scope of games made available is limited by the
availability from the manufacturers. We therefore cannot guarantee that certain games, tools and/or modifications will
be made available to you.
4.4 The user will have access to a private FTP (File Transfer Protocol) area which
will be used exclusively for the administration of the virtual server. In addition to this we also provide a
separate FTP area for users to download log files. However at no time time will we guarantee the accuracy or
completeness of the content created by the virtual servers.
4.5 The FTP area is not to be used to exchange
files with others, to back up data or some other use that is not in direct connection with the administration of the
virtual server.
4.6 4players reserves the right (to prevent any possible misuse) to erase data on the FTP
area at its discretion.
4.7 4Players accepts no responsibility for the misuse of a rented virtual server by
third parties. This incluides acquisitions, the hacking of voice communications and disruptive, abusive or illegal
activity whilst playing on the game servers.
4.8 We do our upmost to ensure that the server is available
throughout the year however there can be occasions when the server is unavailable due to technical errors or other
problems beyond our control. On occasions where the the security of the network may be compromised we reserve the right
to restrict access on a temporary basis.
4.9 We cannot guarantee that users integrating their own data onto
the FTP server will be able to access this. Furthermore we cannot guarantee that program parts, modfications or other
information will remain fully functional.
4.10 We reserve the right to shut down the virtual dedicated server
on a temprary basis for maintenance and other organisational purposes. Planned shutdowns such as this will be
communicated atleast 48 hours before being implemented.
4.11 Instances where we will not be able to inform
the user of this in advance include short term shutdowns for reasons such as specific game patch updates. The said
updates will take place between 04:00 and 10:00 and require the need to reboot the server. This can cause momentary
interuptions in player mode.
4.12 Each game server contract will be for a minimum term. This contract will be
automatically extended unless a cancellation request is placed in writing to the relevant address within the agreed
period.
5. Terms for My4Players
system5.1 4Players provides users with an online payment system otherwise referred to as the
My4Players system. My4Players users can pay via the portal for services ordered in the 4players store. Payment for the
service can be made by PayPal.
5.2 By registering with the My4Players system, the user will automatically be
assigned an online account.
5.3 4Players will not be liable for any damages such as loss of data, resulting
from the submitting of incorrect information during the registrastion process.
5.4 Any false information
provided in connection with the 4players system will be deemed as a breach of these terms and conmditions and will lead
to the immediate blocking of the user account. The user will also be held liable for any damages arising from this
action.
5.5 The user has the right to withfraw from the My4Players system in accordance with the withdrawal
terms as set out in this document.
6. Pricing
policy6.1 All prices shown on the website are in pounds sterling and inclusive of VAT
at 20%. Where applicable, VAT may change from time to time. In case we use a special sale offer price please note that
this might be a limited period offer which we will then indicate.
6.2 Acceptance of your order and formation
of the contract will only take place once we have confirmed your card authorisation.
7. Payment7.1 We accept PayPal along with both credit
& debit cards. Payment types accepted are: Visa, Master card and American Express. We take payment from your card at
the time we process your order ready for despatch.
7.2 All credit card and debit card holders are subject to
validity checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to
us, we will not be liable for any delay or non-delivery.
8. Availbility8.1 The scope of games for download made available is limited by
the availability from the manufacturers. We therefore cannot guarantee that certain games, tools and/or modifications
will be made available to you.
8.2 If an offer is subject to a limited period of availability or is made
subject to conditions, this will be explicitly mentioned in the offer.
9. Cancellation9.1 The length of subscription is
determined by the game and package chosen by the user.
9.2 Subscriptions are shown on a price per month basis but will be charged as one lump sum when taking out the
contract.
9.3 Failure to cancel the selected subscription will result in the contract being extended for another term of the minimum contract term.
9.4 The price for this service remains the same as when the subscription was first taken out.
10. Our Liability
10.1
4Players does not guarantee the permanent availability of its services.
10.2 We will not be held liable for
damages arising from non-availability of the services, accept in cases of gross negligence or intent.
10.3
4Players assumes no responsibility for the accuracy, legality, completeness and value of offers by third parties.
Moreover 4Players is not responsible for the accuracy and completeness of information and data provided by third parties
on the sites of 4Players.
10.4 4Players assumes no liability or guarantee for the software used by third
parties.
10.5 We will instruct the user to the fact that the software is from a third party and will
therefore take no responsibility for any errors within the functionality of the software.
Final
provisions
In the event of any of these Terms and Conditions to be invalid or unenforceable the
remainder of these Terms and Conditions will remain in place. No waiver by us shall be construed as a waiver of any
proceeding or succeeding breach of any provision.
We will not be liable or responsible for any failure to
perform, or delay in performance of, any of our obligations under these Terms and Conditions that is caused by events
outside our reasonable control which includes any strikes, civil commotion, terrorist attack or threat of terrorist
attack, , fire, explosion, flood, other natural disaster, impossibility of the use of public or private transport,
impossibility of the use of public or private telecommunications networks or any acts, decrees, legislation, regulations
or restrictions of any government.
If any of these Terms and Conditions are determined by any competent
authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent
be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent
permitted by law.
These Terms and Conditions and any document expressly referred to in them represent the
entire agreement between us in relation to the subject matter of any contract and supersede any prior agreement,
understanding or arrangement between us, whether oral or in writing.
We each acknowledge that, in entering
into a contract, neither of us has relied on any representation, undertaking or promise given by the other or be implied
from anything said or written in negotiations between us prior to such contract except as expressly stated in these
terms and conditions.
Neither of us shall have any remedy in respect of any untrue statement made by the
other, whether orally or in writing, prior to the date of any Contract (unless such untrue statement was made
fraudulently) and the other party's only remedy shall be for breach of contract as provided in these terms and
conditions.
